1.2. All services are delivered on a project or retainer basis and are subject to a separate Service Agreement or Proposal.
2. User Eligibility
2.1. You must be at least 18 years old to use our Site and Services. By using the Site, you represent and warrant that you are of legal age and have the authority to bind any business entity you represent.
3. User Accounts and Communications
3.1. You may contact us through our contact form or email. Any information you submit must be accurate and truthful. You are responsible for maintaining the confidentiality of any login credentials (if applicable in the future) and for all activities under your account.
4. Intellectual Property

5.2. All payments are non-refundable unless otherwise stated in the specific agreement.
5.3. We reserve the right to suspend or terminate Services for non-payment.
6. Client ResponsibilitiesYou agree to:
6.1. Provide accurate and complete information necessary for us to deliver the Services.
6.2. Give us timely access to your systems, accounts, and data as reasonably required.
6.3. Cooperate in a professional manner during the project.
7. Warranties and Disclaimers

7.2.2. AI automations will be 100% error-free or uninterrupted.
7.2.3. Results (such as time savings or ROI) will be guaranteed.
7.3. We are not responsible for any third-party tools, platforms, or services (e.g., Zapier, Make.com, OpenAI, Google Workspace, etc.) that our automations may integrate with.
8. Limitation of Liability
8.1. To the fullest extent permitted by law, Toaster Uprising HQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to these Terms or our Services, even if advised of the possibility of such damages.
8.2. Our total liability shall not exceed the total amount paid by you for the specific Services giving rise to the claim.
9. Indemnification
9.1. You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
9.1.1. Your breach of these Terms
9.1.2. Your misuse of the Site or Services
9.1.3. Any content or data you provide to us
10. Termination

11. Governing Law
11.1. These Terms shall be governed by the laws of the United States and the State of New Jersey without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in morris County, New Jersey.
